1. INTRODUCTION
Welcome to Queerchata LLC ("Queerchata," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, located at www.queerchata.com (the "Site"), as well as your participation in our in-person dance classes and purchase of merchandise (collectively, the "Services").

Queerchata is a dance instruction and merchandise company headquartered at 330 N Westlake Ave, PH6, Los Angeles, CA 90026, United States.

By accessing or using our Services, or by purchasing any products or services from us, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use our Services.

2. ELIGIBILITY
You must be at least 18 years of age to create an account, purchase merchandise, or register for classes through our Site. Participants under 18 may attend certain designated classes with prior written consent from a parent or legal guardian and may be subject to additional terms and conditions.
By using our Services, you represent and warrant that you meet all eligibility requirements outlined in these Terms.

3. ACCOUNT REGISTRATION

3.1 Account Creation
To access certain features of our Services, including class registration and merchandise purchases, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. DANCE CLASSES

4.1 Registration and Payment
All dance class registrations must be made through our Site or in person at our authorized locations. Payment for classes must be made at the time of registration unless otherwise specified. We accept major credit cards, debit cards, and other payment methods as indicated on our Site.

4.2 Class Policies
Classes are subject to availability and may be canceled or rescheduled at our discretion.
Class sizes are limited and registration is on a first-come, first-served basis.
We reserve the right to refuse service to anyone for any reason at our sole discretion.
Instructors are subject to change without notice.

4.3 Cancellations and Refunds
All sales are final. We are a small organization and we do not offer refunds at the moment. For questions please contact us at dance (at) queerchata.com
We reserve the right to cancel classes due to insufficient enrollment, instructor illness, inclement weather, or other circumstances beyond our control. In such cases, participants will receive a full refund.

4.4 Conduct
Participants are expected to conduct themselves in a respectful manner. Harassment, discrimination, or behavior that creates an unsafe or unwelcoming environment will not be tolerated. We reserve the right to remove participants from classes for inappropriate behavior without refund.

5. MERCHANDISE SALES
‍

5.1 Product Information
We strive to display our products accurately on our Site. However, we do not guarantee that product descriptions, colors, or other content on the Site are accurate, complete, reliable, current, or error-free.

5.2 Pricing and Payment
All prices are listed in USD and are subject to change without notice. Applicable taxes and shipping fees will be added at checkout. We accept major credit cards, debit cards, and other payment methods as indicated on our Site.

5.3 Shipping
We ship merchandise to addresses in the United States and Canada only.
Shipping times are estimated and not guaranteed.
Risk of loss and title pass to you upon delivery of merchandise to the carrier.

5.4 Returns and Exchanges

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

By submitting content to our Site (including but not limited to reviews, comments, and social media posts), you grant Queerchata a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

8.2 Physical Activity Disclaimer
Dance classes involve physical activity. By participating in our classes, you assume all risks associated with such activities. You represent that you are in good physical condition and do not have any medical condition that would prevent you from safely participating in dance classes.

8.3 Limitation of Liability
IN NO EVENT SHALL QUEERCHATA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO QUEERCHATA FOR THE SERVICES GIVING RISE TO THE CLAIM.

9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Queerchata, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

10. DISPUTE RESOLUTION

10.1 Governing Law
These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.
